This End User License Agreement (“Agreement”) is a binding agreement between you (“User” or “you”) and Francophone In English (“Company,” “we,” “us,” or “our”).
This Agreement governs your use of:
- The Francophone In English mobile application (“App”)
- The Francophone In English website (“Site”)
- All content, translations, features, and services offered through these platforms (collectively, the “Services”).
By downloading, installing, accessing, or using the App or Services, you agree to be bound by this Agreement and our Privacy Policy. IF YOU DO NOT AGREE, DO NOT USE THE APP.
1. LICENSE GRANT
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install the App on a device you own or control.
- Access and use the Services for your personal, non-commercial use only.
This license does not transfer ownership of any content, translations, or intellectual property.
2. ELIGIBILITY
To use the App, you must:
- Be at least 13 years old (or the legal age in your region if higher).
- Have the legal authority to enter into this Agreement.
- Use the App only in accordance with applicable laws and licensing rules.
Parents/guardians are responsible for use by minors.
3. ACCOUNT REGISTRATION
To access certain features, including:
- Saving favorites.
- Premium features.
- Song request credits.
- Subscription management.
- Search songs.
…you must create an account.
You agree to:
- Provide accurate and complete information.
- Keep your login credentials confidential.
- Notify us immediately of unauthorized access.
We may suspend or terminate accounts that violate our terms.
4. SUBSCRIPTIONS & PAYMENTS
Francophone In English offers:
- Monthly subscription.
- Yearly subscription.
- Optional one-time purchases such as request credits.
- A lifetime subscription.
Auto-Renewal
All recurring subscriptions automatically renew unless you cancel at least 24 hours before the renewal date.
Payment Processing
Payments are processed through:
- Apple App Store (iOS)
- Google Play Store (Android)
Your billing relationship is with the respective store, not with us.
Pricing
Prices may vary based on region and currency.
We reserve the right to update pricing; changes will appear in the store listing.
5. RESTORE PURCHASES
iOS users may restore previously purchased subscriptions or credits by using the “Restore Purchases” button within the App.
If you change devices, reinstall the App, or switch Apple IDs, you must restore purchases manually.
6. USER RESPONSIBILITIES
You agree not to:
- Copy, modify, or reverse engineer the App.
- Reproduce or redistribute any contextual translations or lyric interpretations.
- Use the Services to violate copyright laws.
- Circumvent subscription paywalls.
- Access the App using automated tools or scripts.
- Harass, exploit, or harm other users.
- Attempt to access restricted or premium features without authorization.
We may restrict, suspend, or terminate accounts that violate these terms.
7. CONTENT PROVIDED BY FRANCOPHONE IN ENGLISH
Francophone In English provides:
- Contextual translations of French and Lingala songs.
- Explanations of idioms, slang, and cultural references.
- Language learning insights.
- Transcription-assisted lyric interpretation.
Important Note on Lyrics
We do not provide original copyrighted lyrics unless:
- They are supplied by rights holders.
- They are publicly available and permitted for use.
- They fall under fair-use/quotation criteria for educational, commentary, and translation purposes.
Where lyrics cannot legally be displayed, we provide:
- Summaries.
- Contextual explanations.
- Translation-based interpretations.
We are not a lyrics distribution service, and we do not claim ownership of underlying musical works.
8. USER CONTENT
If the App allows you to submit content (e.g., comments, requests), you grant us a worldwide, non-exclusive, royalty-free license to:
- Store
- Display
- Use
- Process
…your submitted content solely to operate and improve the App.
We may remove Content that violates guidelines or legal requirements.
9. THIRD-PARTY INTEGRATIONS
The App may integrate with third-party services such as:
- Spotify
- Apple Music
To use playback features, you must:
- Have the relevant music app installed.
- Have an active account.
- Be logged in.
- Maintain an active internet connection.
We do not control third-party apps or guarantee their functionality, uptime, or API availability.
10. INTELLECTUAL PROPERTY
All intellectual property related to:
- Translations
- App design
- Code
- Branding
- Educational material
- UI/UX flows
- Song explanations
- Data models
…are owned exclusively by Francophone In English.
You may not:
- Copy
- Redistribute
- Sell
- Republish
- Scrape
- Train AI on our content without written permission
11. PROHIBITED BEHAVIOR
You may not use the Services to:
- Break copyright law.
- Publish or distribute copyrighted song lyrics without permission.
- Upload malware.
- Abuse or spam features.
- Misrepresent identity.
- Decompile the App.
- Attempt to bypass subscription paywalls.
Any violation may result in account termination or legal action.
12. TERMINATION
We may suspend or terminate your access:
- For violating this Agreement.
- For fraudulent activity.
- If required by law.
- If the App is discontinued.
You may stop using the App at any time.
Subscriptions must be canceled through your app store.
13. DISCLAIMERS
The App is provided “as is” and “as available.”
We do not guarantee:
- 100% accuracy of translations.
- Continuous availability.
- Compatibility with all devices.
- Error-free functionality.
- Continuous access to third-party APIs (e.g., Spotify).
You use the App at your own risk.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for:
- Loss of data.
- Loss of revenue.
- Third-party service failures.
- Device issues.
- API changes by Spotify/Apple.
- Misinterpretation of translations.
- Legal claims regarding copyrighted lyrics.
Total liability will not exceed the amount you paid for the App in the last 12 months.
15. GOVERNING LAW
This Agreement is governed by Kenyan law.
You agree to resolve disputes through binding arbitration or courts within the stated jurisdiction.
16. CHANGES TO THIS AGREEMENT
We may update the EULA periodically.
If changes are significant, we will notify you via:
- App update notes
- In-App notification
Continued use of the App after changes constitutes acceptance.
17. MAINTENANCE & SUPPORT
Francophone In English, not Apple, is solely responsible for:
• Providing maintenance and support
• Addressing bugs or defects
• Handling user questions or issues
Apple has no obligation to provide maintenance or support for the App.
18. PRODUCT CLAIMS
Francophone In English, not Apple, is responsible for handling:
• Any claims that the App fails to conform to legal or regulatory requirements
• Consumer protection claims
• Intellectual property claims
• Product liability claims
Apple bears no responsibility for such claims.
19. WARRANTY DISCLAIMER
The App is provided “AS IS” without warranties of any kind.
Apple is not responsible for:
• Warranty obligations
• Support
• Performance of the App
• Accuracy of translations
To the extent any warranty exists under law, we—not Apple—are responsible for it.
20. EXPORT CONTROL
You may not use or export the App except as permitted under Kenyan and international export laws.
You represent you are not located in an embargoed country or on a restricted-party list.
21. THIRD-PARTY BENEFICIARY CLAUSE
Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement.
Upon your acceptance of this Agreement, Apple has the right (and will be deemed to have accepted the right) to enforce this Agreement against you.
